Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the img.shred mobile application ("App," "Service," or "img.shred") developed and operated by Tuğcan Topaloğlu ("we," "us," or "our").

By downloading, installing, accessing, or using img.shred, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

img.shred is a photo gallery management application that helps users:

• Identify duplicate photos in their device's photo library
• Find visually similar images
• Detect and organize screenshots
• Identify burst photos
• Locate large files consuming storage space
• Review and selectively delete unwanted photos

All processing is performed locally on your device. We do not access, upload, or store your photos.

3. Eligibility

You must be at least 13 years old to use img.shred. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for your personal, non-commercial purposes

5. Restrictions

You agree not to:

• Copy, modify, or distribute the App or any part thereof
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any unlawful purpose
• Circumvent any technological measures designed to control access to the App
• Use the App in any manner that could damage, disable, or impair the App
• Attempt to gain unauthorized access to any systems or networks connected to the App

6. In-App Purchases

6.1 Pro Features

img.shred offers optional in-app purchases to unlock Pro features, including unlimited daily swipes. These purchases are one-time payments that grant lifetime access to Pro features.

6.2 Payment Processing

All purchases are processed through Apple's App Store. Your purchase is subject to Apple's terms and conditions. We do not have access to your payment information.

6.3 Refunds

Refund requests must be submitted to Apple in accordance with their refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.

6.4 Restoring Purchases

You can restore previous purchases at any time using the "Restore Purchase" feature in the App's settings. Purchases are tied to your Apple ID and can be restored on any device signed into the same account.

7. User Responsibilities

You are responsible for:

• Reviewing before deleting: Always review photos in the deletion queue before confirming deletion
• Backing up important photos: Ensure important photos are backed up before using the App
• Granting appropriate permissions: The App requires photo library access to function
• Understanding that deletions are permanent: Once photos are deleted from your device, they may not be recoverable

8. Disclaimers

8.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee of Accuracy

While we strive to provide accurate duplicate and similarity detection, we do not guarantee that the App will correctly identify all duplicates or that no important photos will be mistakenly suggested for deletion. Always review suggestions before confirming deletion.

8.3 No Guarantee of Availability

We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of photos or data
• Loss of profits or revenue
• Loss of use or functionality
• Personal injury or property damage

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tuğcan Topaloğlu and any affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App or violation of these Terms.

11. Intellectual Property

The App, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof), is owned by Tuğcan Topaloğlu and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your use of the App at any time by uninstalling it from your device.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the competent courts of Istanbul, Turkey.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
